If a request for a hearing has caused a recipient's assistance to be reinstated or continued pending the hearing under 7 AAC 49.190, and if the final decision is that the department action at issue was correct, the administrative law judge may order the recipient to repay the assistance provided during the hearing process. Nothing in this section limits the ability of the department to seek recoupment of assistance paid as authorized under state or federal law.
