During a hearing under this chapter,

1. (1) the recipient has the right to self-representation, representation by an attorney, or the assistance of an agent under a power of attorney, a guardian, a family member, a friend, or another person who may be helpful in the presentation of the case;
2. (2) the department has the right to self-representation or representation by an attorney; and

3. (3) the recipient, the department, the recipient's authorized representative, or a person who has been designated to assist the recipient has the right to

   1. (A) present witnesses and documents relevant to the case;
   2. (B) establish facts and advance arguments relevant to the case;
   3. (C) question or refute testimony or evidence, including the opportunity to confront and cross-examine adverse witnesses; and
   4. (D) request a de novo review in a hearing related to the administration of the Medicaid program.
