(a) The department may conduct a special review of the eligibility of an assistance unit in the same manner as it would treat the eligibility of a new assistance unit. In conducting a special review, the department may
- (1) require an eligible signer to complete a new application on behalf of the assistance unit;
- (2) conduct a face-to-face interview in accordance with 7 AAC 45.170;
- (3) review the completeness of verification and documentation of all factors of eligibility not normally subject to change;
- (4) verify all factors subject to change; and
- (5) review any other factor or matter relating to the recipient's receipt of ATAP benefits.
- (b) If the recipient fails to submit the review application and cooperate in providing all necessary verifications, the department will terminate ATAP benefits to that assistance unit.
(c) The department may conduct a special review if
- (1) a recipient fails to cooperate with an inquiry that is conducted by the department to verify information provided to the department under this chapter;
- (2) the department discovers one or more changes that were not reported to the department by the recipient;
- (3) the department receives a report of several changes happening at one time that will involve extensive verification and that will call into question the recipient's eligibility;
- (4) a change in federal or state law may affect the eligibility of a number of ATAP cases of a certain type;
- (5) a review procedure would assist the department and a recipient in complying with and understanding changes in federal or state law;
- (6) a recipient moves from one district of the division handling public assistance matters in the department to another or moves to any location that may affect eligibility;
- (7) a parent's inability to perform gainful activity needs to be re-evaluated; or
- (8) the department's fraud unit recommends a review.
