(a) When first applying for ATAP benefits in this state, an applicant shall submit a new application even if the applicant is already a recipient of
- (1) another assistance program in this state that uses the same application form; or
- (2) an assistance program in another state.
(b) A new application for ATAP benefits is required
- (1) when a recipient or former recipient is reapplying after a previous application was closed, denied, or withdrawn, or that individual's status as a recipient was terminated, unless that action was caused solely by administrative error or by factors totally beyond the control of the applicant;
- (2) if the recipient's circumstances change to the extent that the department must make a redetermination of eligibility under 7 AAC 45.560;
- (3) if there is a change in the caretaker relative with whom an ATAP eligible child is living; or
- (4) if otherwise provided for in this chapter or AS 47.27.
(c) A new application for ATAP benefits is not required
- (1) to reinstate the benefits of a recipient whose benefits were terminated if that recipient has made a timely request for a fair hearing, or if reinstatement is ordered by a hearing officer or the court;
- (2) if an assistance unit, as described in 7 AAC 45.335, changes in status from adult-included to child-only under 7 AAC 45.520, or vice versa;
- (3) if there is a change in a "payee" or an "in care of" address; or
- (4) if the department suspends recipient status for one month.
