- (a) An eligible applicant who is eligible for SSI and who is a patient in a nursing home or hospital under 7 AAC 105 - 7 AAC 160 may receive a monthly payment for incidental personal needs from the Social Security Administration in accordance with 20 C.F.R. 416.414. An additional payment will be made under this chapter, if necessary, to provide a total of $75 per calendar month for incidental personal needs.
- (b) An eligible applicant whose income exceeds SSI income standards who is a patient in a nursing home or hospital under 7 AAC 105 - 7 AAC 160 may retain $75 per calendar month for incidental personal needs, in accordance with 7 AAC 140.575.
- (c) Subsections (a) and (b) in this section apply in any month in which the applicant resides in a hospital or nursing home continuously for the entire calendar month; provided, however, that an absence for not more than 14 consecutive days which does not give rise to discharge and readmission does not preclude continuous residency under this subsection.
- (d) For purposes of this section "patient" does not include a recipient who is eligible for payments under 7 AAC 40.385.
