The commissioner will consider the following factors to determine whether a site has either regular or very hard-to-fill positions, or both:

1. (1) the length of time to fill a vacancy, including

   1. (A) evidence of Internet postings for 12 months or longer; or
   2. (B) evidence that a locum tenens or other short-term provider filled the position;

2. (2) the length of time of active recruitment for a vacant position, including evidence of

   1. (A) actual job postings and the actual dates of posting; or
   2. (B) whether the position was posted during the most recent 12 months in journals, in newspapers, or on the Internet before the commissioner's determination of an eligible site under 7 AAC 24.021;

3. (3) interviews conducted during the most recent 12 months before the commissioner's determination of an eligible site under 7 AAC 24.021, including

   1. (A) who was interviewed; and
   2. (B) the reasons for not hiring an individual who was interviewed.
