1. (a) After a decennial report is determined to meet the requirements of 6 AAC 93.140, the CDQ evaluation team will evaluate each CDQ entity's determination of whether the submitting CDQ entity maintained or improved its overall performance with respect to the criteria set out in 16 U.S.C. 1855(i)(1)(H)(ii).

2. (b) After the evaluation under (a) of this section, the Department of Commerce, Community, and Economic Development, on behalf of the CDQ evaluation team, will provide written notice, to the submitting CDQ entity and to NMFS, of the state's proposed recommendation regarding whether the CDQ entity

   1. (1) has maintained or improved its overall performance with respect to the criteria; or
   2. (2) has not maintained or improved its overall performance with respect to the criteria.
