(a) The department may issue a permit to take foxes for the purposes of protecting or enhancing the recovery of nesting migratory birds. The issuance of a permit must
- (1) be supported by a plan of operations that includes an adequate justification for fox removal, such as protection of threatened or endangered species, restoration of secure breeding areas, and enhancement of diminished nesting colonies; and
- (2) demonstrate sufficient positive benefits to migratory birds.
(b) A permit issued under this section must include
- (1) the name of the permittee and authorized subpermittees;
- (2) the species and number of foxes to be taken;
- (3) methods and means that may be employed;
- (4) duration of the permit;
- (5) location of the permitted activities;
- (6) disposition of the foxes that are taken; and
- (7) reporting requirements.
- (c) The department must provide annually, to the Board of Game, a report of program activities and permits issued during the preceding 12 months.
