- (a) When a requested increase is approved, the increase is retroactive to the effective date specified in the notice of increase.
- (b) Rent increases having an effective date within the 120 days before the declaration of a housing emergency, which are paid but which are later denied in whole or in part, shall not be refunded to the tenant.
- (c) Proposed rent increases having an effective date after the declaration of a housing emergency, which a tenant mistakenly pays and is subsequently denied in whole or in part, shall be refunded to the tenant.
