- (a) The ombudsman shall maintain a confidential record received from an agency subject to the same restrictions on disclosure that apply while the record is in the custody of the agency.
- (b) If another agency would have access to a confidential record during the normal course of business, then the ombudsman may disclose the record to that agency to the same extent that it could be disclosed by originating agency.
- (c) If the agency providing a confidential record informs the ombudsman that access to the record is restricted to specific employees within the agency, the ombudsman may request a written explanation of the limits on disclosure and the applicable law.
