When the ombudsman's resources are insufficient for adequate investigation due to the number of pending complaints, the ombudsman will consider the following priorities for selecting complaints for investigation:
- (1) complaints alleging an emergency in which delay would subject the complainant to a substantial risk of serious and irreparable harm;
- (2) complaints alleging prejudice, harm, or disadvantage for which the ombudsman believes that the possibility of an effective remedy requires investigation with minimal delay;
- (3) complaints alleging recurring prejudice, harm, or disadvantage to multiple persons due to an administrative act;
- (4) complaints alleging a single or isolated instance of prejudice, harm, or disadvantage that has already occurred and thus cannot be prevented by an ombudsman's investigation.
