Alaska Admin. Code tit. 20, § 25.1420 – Termination of permit

(a) The commission may, on a request for review by any interested person, or on the commission's initiative, terminate a storage facility permit during its term, or deny a permit renewal application for the following causes:
1. (1) noncompliance by the storage operator with any condition of the permit;
2. (2) the storage operator's failure in the application or during the permit issuance process to disclose fully all relevant facts, or the storage operator's misrepresentation of any relevant facts at any time; or
3. (3) a determination that the permitted activity endangers human health or the environment and can only be regulated to acceptable levels by permit modification or termination.
(b) If the commission tentatively decides to terminate a permit, the commission will issue notice of intent to terminate. A notice of intent to terminate is a type of draft permit which shall be subject to the applicable procedures in 20 AAC 25.1150.
