1. (a) A person or entity desiring to function as an agent or independent recruiter shall apply to the commission for an agent's permit. The complete application as required under AS 14.48.080(a), including the fee required by 20 AAC 17.055(b), evidence of bonding, cash deposit, or other security required under 20 AAC 17.045, and all forms and documents required by the application instructions, must be received by the commission at least 90 days before the next scheduled commission meeting.
2. (b) Upon receipt of the completed application, accompanying documents, appropriate fees, and evidence of bonding, the commission staff shall place the application on the commission's agenda for review and action. The commission will notify the applicant in writing of its decision.
3. (c) An agent's permit is nontransferable and is issued for terms of between six months and two years. However, under no circumstances will the agent's permit remain valid beyond the expiration date of the authorization to operate for the institution which the agent represents if such authorization is required.
4. (d) For purposes of this section, an agent who is a bona fide employee of a postsecondary educational institution authorized to operate in this state or exempted from authorization, and who acts as an agent only in the scope of the agent's employment with the postsecondary educational institution, is exempt from the agent permit requirement of this section.
