Interim-use permits before establishment of priority classifications

- (a) Before the commission establishes the maximum number of entry permits for a fishery not subject to a moratorium on new entrants, the commission will issue and renew interim-use permits to persons who submit applications under 20 AAC 05.425 and who establish their present ability to participate actively as a gear operator in the fishery.
(b) After the commission establishes the maximum number of entry permits for a fishery and before the applicant is assigned to a priority classification under 20 AAC 05.540, an interim-use permit under this section will be issued only to an applicant who
- (1) submits an application under 20 AAC 05.425; and
- (2) harvested the fishery resource commercially as a holder of a valid gear license or interim-use permit before January 1 of the year in which the maximum number is established and during a year which the commission specifies for eligibility purposes under AS 16.43.260(a).
- (c) An interim-use permit issued under this section cannot be renewed after the applicant is assigned to a priority classification under 20 AAC 05.540; the issuance of interim-use permits to these applicants is governed by 20 AAC 05.415.
