When the department requests the municipality's approval of the department's proposal to issue a permit under 18 AAC 87.210(b)(3)(A), but the municipality with jurisdiction does not issue an approval, the municipality shall provide the department with a detailed basis for the decision. The municipality may not base its decision upon radiological or nuclear safety.
