For storm water discharges from construction activity identified in 40 C.F.R. 122.26(b)(14)(x), adopted by reference in 18 AAC 83.010, the department may include permit conditions that incorporate qualifying state, tribal, or local erosion and sediment control program requirements by reference. A qualifying state, tribal, or local erosion and sediment control program is one that includes the elements listed in 18 AAC 83.505 and any additional requirements necessary to achieve the applicable technology-based standards of best available technology and best conventional technology as determined by the department using best professional judgment.
