When the department issues a permit to a facility that may operate at certain times as a means of transportation over water, the permit must require the discharge to comply with any applicable regulation promulgated by the secretary of the department in which the United States Coast Guard is operating that establishes specifications for safe transportation, handling, carriage, and storage of pollutants.
