The requirements of 40 C.F.R. 141.600 - 141.605 (Subpart U - initial distribution system evaluations), adopted by reference in 18 AAC 80.010(a), apply to a

1. (1) community water system that uses a primary or residual disinfectant other than ultraviolet light or delivers water that has been treated with a primary or residual disinfectant other than ultraviolet light; and

2. (2) non-transient non-community water system that serves at least 10,000 individuals and

   1. (A) uses a primary or residual disinfectant other than ultraviolet light; or
   2. (B) delivers water that has been treated with a primary or residual disinfectant other than ultraviolet light.
