The department will, in its discretion, and after giving notice to the permittee, terminate a permit issued under 18 AAC 75.810 if the department finds that

1. (1) the permit was obtained by misrepresentation of a material fact or by failure of the applicant to fully disclose the facts;
2. (2) there has been noncompliance with a term or condition of the permit; or
3. (3) based on information received after issuance of the permit, the permit should not have been granted.
