If a person required to provide proof of financial responsibility under AS 46.04.040, AS 46.04.055, or 18 AAC 75.205 - 18 AAC 75.290 fails or refuses to do so, the department will, in its discretion,

1. (1) seek civil assessments and costs under AS 46.03.760 or other appropriate statutes for each separate violation of AS 46.04.040 or 46.04.055, or of 18 AAC 75.205 - 18 AAC 75.290;
2. (2) take action to halt the operation of a vessel or facility that is not in compliance with AS 46.04.040, AS 46.04.055, or 18 AAC 75.205 - 18 AAC 75.290;
3. (3) take action to deny entry to a vessel to the navigable waters of the state;
4. (4) take action to detain a vessel that does not produce, upon the department's request, a current, valid certificate of proof of financial responsibility issued under 18 AAC 75.205 - 18 AAC 75.290; or
5. (5) take such other and further action as may be warranted by the circumstances.
