1. (a) The department will, in its discretion, and on its own motion or upon application by any person, issue a general permit for activities that produce wastewater and that

   1. (1) require a permit under 18 AAC 72.010 or 18 AAC 72.500;
   2. (2) involve the same or very similar type of operation;
   3. (3) discharge the same type of wastewater;
   4. (4) require the same effluent limitation or operating conditions, or similar monitoring requirements;
   5. (5) will not threaten public health or water quality; and
   6. (6) in the department's opinion are better controlled under a general permit.

2. (b) A general permit will apply to a class of disposal activities discharging within a specified area. The area will correspond to geographic or political boundaries such as

   1. (1) municipal boundaries;
   2. (2) water bodies or drainages; or
   3. (3) any other appropriate geographic division or combination of boundaries.

3. (c) A general permit will define the covered disposal activities by identifying the

   1. (1) class of disposal activities;
   2. (2) duration, frequency, and amount of disposal;
   3. (3) physical and chemical characteristics of disposal;
   4. (4) location and method of disposal;
   5. (5) treatment required before disposal;
   6. (6) water and land areas able to receive the disposal; and
   7. (7) any other factors that the department determines are important in granting a general permit.
4. (d) The department will include appropriate conditions in each general permit.
5. (e) The department will, in its discretion, require applicants to have written approval before conducting particular disposal activities under a general permit.
6. (f) Authorization to discharge under a general permit issued by the department under this section does not satisfy any requirements for a permit under 33 U.S.C. 1342 or for a permit under 18 AAC 83.005 - 18 AAC 83.990.
