1. (a) A plan submitted for department approval under 18 AAC 72.200 for construction or modification of a wastewater treatment works must include

   1. (1) the items required to be submitted under 18 AAC 72.205;
   2. (2) plans, reports, and drawings sealed by a registered engineer;

   3. (3) the design calculations or design criteria for the following parameters:

      1. (A) design flows and wastewater loading rates;
      2. (B) treatment capacities and expected effluent quality;
      3. (C) selection and arrangement of unit operations and processes;
      4. (D) material and equipment selection and specifications;
      5. (E) siting with respect to potential for health hazards, nuisances, flooding, and effect on groundwater and surface waters;
      6. (F) bedding, backfill and final grading;
      7. (G) methods to control operational variables;
      8. (H) methods and location of disposal of septage, sludges, grit, screenings, and other facility residuals;
      9. (I) thermal protection considerations; and
   4. (4) provisions demonstrating that facility bypasses are controlled and bypasses will not result in a discharge of wastewater that does not meet applicable minimum treatment requirements of this chapter.

2. (b) The separation distance from each part of the treatment works must

   1. (1) meet the minimums set out in 18 AAC 80 for a public water system, unless the department has approved a lesser separation distance under that chapter;
   2. (2) meet the minimums set out in 18 AAC 72.100 for a private water system, unless the department has approved a lesser separation distance under this chapter; and
   3. (3) be a minimum of 100 feet from the mean annual high water level of a lake, river, stream, spring, or slough, or the mean higher high water level of tidally influenced coastal waters.

3. (c) To obtain an approval to operate a wastewater treatment works, the applicant shall submit to the department

   1. (1) items required under 18 AAC 72.240; and
   2. (2) if requested, a copy of the operations and maintenance manual developed in accordance with manufacturer recommendations and specifically addressing the system as installed.
4. (d) If a discharge permit is not required, the department may require periodic testing and reports that demonstrate the system meets expected performance criteria.
