1. (a) The definitions in 40 C.F.R. 260.10, revised as of December 7, 2023, are adopted by reference and apply to 18 AAC 62.010 - 18 AAC 62.1160. The substitution of terms referenced in 18 AAC 62.040(a) does not apply to the definition in 40 C.F.R. 260.10 of "Act or RCRA."
2. (b) The definitions in 40 C.F.R. 279.1, revised as of July 1, 2022, are adopted by reference, and apply to 18 AAC 62.1200 - 18 AAC 62.1280.

3. (c) In this chapter, unless the context requires otherwise,

   1. (1) "department" means the Department of Environmental Conservation;

   2. (2) "electronic waste"

      1. (A) includes

         1. (i) hazardous waste that is a device that contains one or more circuit boards or other complex circuitry, including computer components, laptops, central processing units, mouses, keyboards, monitors, cellular telephones, audio or video devices, and copy machines; and
         2. (ii) components, subassemblies, or other parts derived from the disassembly of electronic items; and
      2. (B) does not include refrigerators, freezers, stoves, dishwashers, washing machines, or dryers;
   3. (3) "EPA" means the United States Environmental Protection Agency;
   4. (4) "generator" has the meaning given in 40 C.F.R. 260.10, adopted by reference in (a) of this section;
   5. (5) "large quantity generator" has the meaning given in 40 C.F.R. 260.10, adopted by reference in (a) of this section;
   6. (6) "manage" has the meaning given "management" in 40 C.F.R. 260.10, adopted by reference in (a) of this section;
   7. (7) "RCRA" means the Resource Conservation and Recovery Act, Subchapter III (42 u.s.c. 6901 - 6939g);
   8. (8) "small quantity generator" has the meaning given in 40 C.F .R. 260.10, adopted by reference in (a) of this section;
   9. (9) "transporter" has the meaning given in 40 C.F.R. 260.10, adopted by reference in (a) of this section;
   10. (10) "universal waste" has the meaning given in 40 C.F.R. 260.10, adopted by reference in (a) of this section;
   11. (11) "universal waste handler" has the meaning given in 40 C.F.R. 260.10, adopted by reference in (a) of this section.
