1. (a) Except as set out in (b) of this section, the provisions of 40 C.F.R. Part 260, Subpart A (general), revised as of January 22, 2025, are adopted by reference.
2. (b) The introductory language of 40 C.F .R. 261.6(a)(2), revised as of July 1, 2022, is adopted by reference, but not that language revised as of December 10, 2024. The provisions of 40 C.F.R. 261.6(a)(2)(v) that took effect December 10, 2024 are not adopted by reference.
3. (c) The substitution of state terms for the EPA and federal officials referenced in 18 AAC 62.040(c) and (d) does not apply to 40 C.F.R. 260.4 and 260.5. The substitution of terms referenced in 18 AAC 62.040(e) for the State of Alaska does not apply to the definitions in 40 C.F.R. 260.10 of "Person," "State," or "United States."
