1. (a) Except as otherwise provided in this section, the department will, and the implementing agency or referee facility may,

   1. (1) inspect a grey market vehicle in accordance with importation documents issued by EPA or the manufacturer's emissions decal; and

   2. (2) issue a certificate of inspection if the grey market vehicle passes, as required by Part IV of the program manual, the

      1. (A) visual and functional inspections and the tailpipe emissions standards; or
      2. (B) OBDII portion of the I/M test.

2. (b) If the importation documents nor the manufacturer's emissions decal are not available, but the grey market vehicle has a United States title and has not been modified to comply with EPA emissions requirements, the department will, and the implementing agency or referee facility may,

   1. (1) inspect the vehicle according to the model year of the vehicle and the emissions control systems present on the vehicle at manufacturing; and

   2. (2) issue a certificate of inspection if the vehicle passes, as required by Part IV of the program manual, the

      1. (A) tailpipe emissions standards; or
      2. (B) OBDII portion of the I/M test.

3. (c) If the importation documents or the manufacturer's emissions decal are not available, but the grey market vehicle has a United States title and has been modified to comply with EPA emissions requirements, the department will, and the implementing agency or referee facility may

   1. (1) inspect the vehicle according to the model year of the vehicle and the emissions control systems present on the vehicle at inspection; and

   2. (2) issue a certificate of inspection if the vehicle passes, as required by Part IV of the program manual, the

      1. (A) tailpipe emissions standards; or
      2. (B) OBDII portion of the I/M test.
4. (d) If the importation documents or the manufacturer's emissions decal are not available, and the grey market vehicle does not have a United States title, the department will not, and the implementing agency or referee facility may not, inspect the vehicle.
5. (e) This section does not relieve a motorist from any duty to obtain importation documents issued by EPA and the United States Department of Transportation.
6. (f) The repair cost minimum is the same for a grey market vehicle as it is for a vehicle manufactured in the United States.
