1. (a) Except for a food establishment described in (b) of this section, the operator of a food establishment shall ensure that

   1. (1) handwash sinks are provided as required by 18 AAC 31.416 and are

      1. (A) used exclusively for handwashing;
      2. (B) supplied with soap and sanitary towels in a dispenser or a hand-drying device that provides heated air; common towels are prohibited;
      3. (C) accessible at all times; and
      4. (D) kept clean and in good repair;
   2. (2) a sign or poster that is clearly visible to employees is posted at each handwash sink used by employees directing employees to wash their hands; and
   3. (3) employees and consumers do not wash their hands at sinks used for preparation or warewashing.

2. (b) The requirements of this section do not apply to a

   1. (1) temporary food service subject to 18 AAC 31.600;
   2. (2) limited food service that dispenses only prepackaged food and that meets the requirements of 18 AAC 31.610(c);
   3. (3) mobile food unit that dispenses only prepackaged food and that meets the requirements of 18 AAC 31.620(g);
   4. (4) mobile retail food vendor that sells only prepackaged food and that meets the requirements of 18 AAC 31.625(a)(1); or
   5. (5) kiosk that sells only prepackaged food and that meets the requirements of 18 AAC 31.615(c).
3. (c) An exemption in (b) of this section does not relieve an operator from complying with requirements of the Department of Labor and Workforce Development.
