An operator may lease a premise to conduct an activity under AS 05.15 that would otherwise qualify as a vendor location if

1. (1) the operator and the lessor of the premises enter into a written lease;
2. (2) the activity is conducted in a separate area of the premises;
3. (3) the activity is conducted by a person under control of the operator not employed by the lessor of the premises; and
4. (4) the lessor and the lessor's employees do not participate as players in the activity.
