A parent may qualify for participation in the arrears forgiveness program based on incarceration under 15 AAC 125.650(a)(3)(B) if

1. (1) the parent was

   1. (A) incarcerated as of the date the parent applied for the arrears forgiveness program and is expected to be released from incarceration within 60 days after the date of application; or
   2. (B) released from incarceration within six months immediately before the date the parent applied for the arrears forgiveness program;
2. (2) the parent was incarcerated for more than one year without interruption during the parent's most recent incarceration before the date the parent applied for the arrears forgiveness program; and
3. (3) the parent had no other means of paying support while incarcerated.
