The commissioner will assign a qualified, unbiased, and impartial hearing officer to conduct a hearing under this chapter. The hearing officer may not

1. (1) have participated in making the decision that will be reviewed at the hearing; or
2. (2) be an immediate supervisor or subordinate of the person who made the decision that will be reviewed at the hearing.
