1. (a) To determine whether a specific act is within the scope of pharmacy practice in or into the state, or whether an act can be delegated to other individuals under a licensee's supervision, the licensee must independently determine whether the act is

   1. (1) expressly prohibited by

      1. (A) this chapter; or
      2. (B) any applicable state or federal laws;
   2. (2) consistent with the licensee's education, training, and experience; and
   3. (3) within the accepted standard of care that would be provided in a similar setting by a reasonable and prudent licensee with similar education, training, and experience.
2. (b) The pharmacist-in-charge shall make necessary changes or improvements to ensure patient safety and employee wellness in a pharmacy, as part of a continuous quality improvement program for pharmacy services.
