- (a) Under the circumstances set out in (b)(1) and (2) of this section for a violation by a permittee that is a corporation, the commissioner may assess a civil penalty against a director, officer, or agent of the corporate permittee, if the director, officer, or agent knowingly and willfully authorized, ordered, or carried out a violation of AS 27.21, this chapter, or a permit condition.
(b) The commissioner will not assess a civil penalty under (a) of this section in situation resulting from a violation by a corporate permittee unless
- (1) the commissioner issues a cessation order to the corporate permittee for a violation; and
- (2) the violation remains unabated for at least 30 days after issuance of the cessation order.
