Y. It is thought that there is .a conflict between the second and fourth instructions that constitutes reversible error. We have said that the fourth instruction, taken alone, is erroneous; but, when the instructions are taken together, we think the jury could not have misapprehended the law of the case. Conceding a¡ technical error in the fourth instruction, we should not reverse the case because of it. The judgment will stand AFFIRMED.
