The undisputed facts appearing in the record were that defendant at a public sale purchased a blooded cow from plaintiff for $350, to be paid in cash or by bankable note; that the cow was delivered to defendant and received by him; that in payment he sent plaintiff a note for the amount, on the back of which was written a memorandum to the effect that it was given
Eor the error pointed out in the last-numbered division of this opinion, the judgment is reversed.
