In an action to compel the determination of claims to real property, the defendants appeal from an order of the Supreme Court, Kings County (Rosenberg, J.), dated August 5, 2005, which (1) granted the plaintiffs’ motion to vacate a prior order of the same court dated May 16, 2005, dismissing the complaint upon their failure to appear at a “trial/settlement conference” and to restore the action to the trial calendar, and (2) denied their cross motion pursuant to
Ordered that the order is affirmed, with costs.
In view of the good cause for the failure of the plaintiffs’ attorney to appear, the Supreme Court correctly declined to award an attorney‘s fee to the defendants pursuant to
H. Miller, J.P., Crane, Krausman, Rivera and Lifson, JJ., concur.
