On April 26, 1940, defendant Andrew J. Smith entered into a land contract whereby he agreed to purchase the land in question, located in Bayfield county, from Patrick Mulligan. The contract was recorded, and pursuant to its terms Smith took possession of the land on June 1, 1940. By the contract he had agreed to pay one half of the taxes for 1939.
On July 7, 1943, plaintiff Walter F. Welsh acquired by assignment from the county treasurer the tax certificate on *414 the premises which had been issued on October 1, 1940, for the tax year of 1939. On the 5th, 12th, and 19th days of July, 1945, plaintiff had a notice of application for tax deed on the certificate published in the Washburn Times, a weekly newspaper published in the county seat of Bayfield county. Plaintiff also served notice of application for tax deed on Ernest Moore of the town of Cable in Bayfield county. This notice, dated June 27, 1945, was intended to meet the statutory requirement set forth below that notice be given to an occupant. Moore did not live on the premises, but he had been given the key to the building on the premises by Andrew J. Smith.
On August 21, 1945, the probate court of Cook county, Illinois, found defendant Smith to be incompetent and appointed a conservator of his estate. On May 8, 1946, the same court adjudicated Smith to be competent. In the meantime, on September 5, 1945, a Chicago attorney engaged by defendant Smith or his conservator, requested the county treasurer of Bayfield county to send the tax bills for the property in question to him so that they could be paid. The requested statement was mailed to, the attorney on September 8, 1945. On September 13th, the attorney wrote another letter to the county treasurer, saying in part: "I noticed from this tax bill that the taxes for the year 1939 were sold in 1940. I also notice from the synopsis of the Wisconsin tax laws that this sale is subject to tax deed five years from date of sale. I also notice that notices have been sent out re tax deeds for the year 1939.
"Therefore, will you kindly advise the writer whether or not this property can be redeemed."
On September 18, 1945, the county treasurer replied to this letter, saying: "This property may be redeemed by the original owner up to. November 1, 1945, and if not redeemed by that time the holder of the tax certificates is entitled to a tax deed."
On November 2, 1945, plaintiff Welsh filed an affidavit of inability to serve defendants personally or by registered mail. *415 This affidavit, together with the proof of publication of the notice of application for tax deed, was flied with the county clerk, and a tax deed was executed and delivered by the county clerk to Welsh that same day.
On May 22, 1946, defendant Smith answered the complaint in the action by Welsh to quiet title, and Smith deposited with the clerk of the circuit court for Bayfield county a check in the sum of $660, representing all taxes, interest, and penalties due on the land involved.
The pertinent statutory provisions regarding tax deeds, as set forth in sec.
"(1) No tax deed shall be issued on any lot or tract of land which has been or shall hereafter be sold for the nonpayment of taxes, unless a written notice of application for tax deed shall have been served upon the owner, or one of the owners of record in the office of register of deeds of the county wherein the land is situated. If such lot or tract be improved by a dwelling house, or building used for business purposes, or a building used for agricultural purposes, and in any of said cases, such building has been actually occupied for the purpose specified for thirty days immediately prior to the date of service of the notice of application for tax deed, or if such lot or tract of land has been occupied and cultivated for agricultural purposes for thirty days within the period of six months immediately prior to the date of service of the notice of application for the tax deed, then notice of application for tax deed shall be served upon the occupant or one of the occupants thereof. . . .
"(2) Such notice shall state the name of the owner and holder of the tax sale certificate, and the date thereof, the description of the lands involved, the amount for which the lands were sold and that such amount will bear interest as provided by law, and shall give notice that after the expiration of threemonths from the date of service of such notice a tax deed will be applied for. . . .
"(3) Such notice of application for tax deed may be served by the owner and holder of any tax sale certificate sold by any county treasurer or by any city treasurer authorized by law to sell lands for nonpayment of city taxes or assessments, or by *416
any person acting for such owner and holder. Such notice shall be served in the manner that service of a summons in a court of record is made, or by registered mail, with return receipt of the addressee only demanded. In the event that such notice cannot be given by use of either of the foregoing methods, the owner and holder of said tax sale certificate or his authorized agent shall make an affidavit setting forth the effort to make such service, the inability to do so, and shall file such affidavit with the county clerk as to county tax sale certificates. . . . In such cases the notice hereinabove provided shall be published by such owner and holder once a week for three successive weeks in a newspaper of general circulation published in the county wherein such lands are located. . . . The affidavit of the owner and holder of the tax salecertificate as to inability to secure service personally or by registeredmail, together with proof of publication of the notice,shall be deemed completed service of the notice of applicationfor tax deed." (Italics ours.)
The strength of a tax deed depends upon whether all the requirements of law governing a sale of real property for taxes have been fully complied with. If any act required by law, such as a proper notice of the application for tax deed by a completed service thereof on the owner, is omitted, the tax deed is not valid. It has been recognized as a valid rule that statutes authorizing and regulating tax sales must be construed for the benefit of the owner. In Klug v.Soldner,
In this case the acts of the respondent in his efforts to acquire the title to the land did not conform to the requirements of the statutes because of his failure to serve the notice as *417
provided for in sec.
The respondent's notice to Moore, even if it be conceded that Moore was an occupant of the premises as defined in sec.
Accordingly, before he could get a valid tax deed, the respondent was bound to serve written notice of his application for a tax deed upon appellant. He has not satisfied the statutory requirements in regard to the notice. Sub. (3), of sec.
Claiming that he was unable to serve appellant personally or to reach him by registered mail, the respondent chose to comply as to notice by filing the affidavit of his inability to secure service personally or by registered mail and by a newspaper publication of the notice. The notices were published for three successive weeks in July, 1945, but the affidavit was not executed until November 2, 1945, the day the tax deed was delivered to the respondent. Respondent contends that the date on which the affidavit was filed is immaterial, so long as it was filed before the tax deed was executed in his favor. The appellant, on the other hand, contends that the affidavit should be filed prior to the newspaper publication of the notice. The trial court, although not specifically mentioning the affidavit as such, was of the opinion that "the failure to make and file notice of intent to take tax deed prior to the first day of publication is not fatal to the proceedings."
The statute does not specifically say when the affidavit of inability to secure service must be filed, but there are several things which indicate that it was the intent of the legislature that the affidavit should be filed before the publication. Sec.

These provisions of the statutes and the general principle that notice requirements are to be interpreted in favor of the owner of property compel us to conclude that respondent's failure to file his affidavit of inability to secure service prior to the first day of publication in July, 1945, was fatal to the proceedings.
There may be room for argument that filing that affidavit before the publication would not have increased the opportunities for appellant to redeem the property. The trial court's opinion was expressed this way: "I have reconsidered very carefully, as I think, the evidence bearing upon the question of whether the plaintiff was aware of, or should have been able to find out where the defendants resided so as to serve notice of taking of tax deed on them personally. I have concluded *420
that he did not know where the defendants were located, that he did use reasonable efforts to find out, and that therefore his service by publication upon the defendants was adequate service." However, an owner, finding no affidavit of inability to secure service on file, might rely on his having at least three more months in which to redeem. It is the obvious intention of sec.
Again, it is questionable whether the respondent should have executed the affidavit he did on November 2, 1945. That affidavit read as follows:
"Walter F. Welsh, being first duly sworn, on oath says that he is the owner and holder . . . of the tax sale certificate described in the annexed notice of application for issue of tax deed.
"That he is unable to make service of said notice personally or by registered mail upon Patrick Mulligan and Andrew J. Smith.
"That affiant has made the following effort to make such service, to wit:
"Record search does not reveal address.
"Also made personal inquiry and was unable to find either party."
At the time when respondent made this affidavit of thorough search for and inability to find the appellant, the letters from appellant's attorney, referred to in the statement of facts, were in the office of the county treasurer. While to have the practical as well as the legal purpose carried out the affidavit ought to precede the publication, if that point is passed the service *421 could still not be complete until the affidavit was filed. And a deed issued before the expiration of three months after completed service would be a nullity, for that is an irregularity which goes to the merits.
By the Court. — Judgment reversed. Cause remanded with directions to dismiss the complaint.
