Following the Supreme Court’s order vacating this court’s judgment, Duncan v. Bonta, 142 S. Ct. 2895 (2022), the en banc court remanded this case to the to the district court for further proceedings consistent with New York State Rifle & Pistol Ass’n, Inc. v. Bruen, 597 U.S. ____, 142 S. Ct. 2111 (2022).

Judge Bumatay and Judge VanDyke dissented from the order remanding this case to the district court.
