The court did not err in sustaining the general demurrer to the petition, which sought to enjoin the defendant from building a house allegedly projecting over on the lands of the plaintiff. This is true for the reason that it appears from the allegations of the petition that the house is being constructed on land belonging to the defendant and not to the plaintiff.
Judgment affirmed. All the Justices concur.
