Jacobs was convicted of possession with intent to distribute. That offense requires “that a defendant: (1) possessed a controlled substance; (2) knew that he possessed a controlled substance; and (3) intended to distribute the controlled substance.”

For the foregoing reasons, the district court’s ruling imposing lifetime ineligibility for federal benefits is VACATED. The case is remanded for resentencing consistent with this opinion.
