TMs was an action of replevin to recover the possession of 30 head of cows, a number of younger cattle, some hogs, and a quantity of farm produce. It appears that the plaintiff had let to the defendant to farm on shares a tract of land, and had agreed to supply the defendant with 40 head of cows to be kept on said premises and milked on shares, and that this 30 head of cows were a part of those so furnished by the plaintiff. We therefore recommend that the judgment of the district court be reversed and the cause remanded for a new trial.
