Since writing the above attention has been called to the decision of Bischoff v. Yorkville Bank by the Court of Appeals, modifying a decision of the Appellate Division (170 App. Div. 679; 218 N. Y. 106). The opinion is instructive upon the question of the participation of a bank in the misappropriation of funds by a depositor, but there is no expression that impairs the result here reached.
