26 1 On May 14, 2021, Petitioner filed a motion to stay the ongoing state court
27 criminal proceedings against him. (Docket No. 33.) This motion is denied for the reasons set 28 forth in the Report and Recommendation.
*2 1 IT IS HEREBY ORDERED that: (1) the First Amended Petition is denied; and (2) Judgment shall be entered dismissing this action without prejudice.
