John Thompson and Walter Eastridge were jointly indicted for the murder of W. B. Shirey. Thompson was placed on trial, and a verdict of guilty was rendered against him, without recommendation. He made a motion for a new trial, which was overruled, and he excepted.
We do not think the charge is open to the criticisms directed against it. It is a full and clear statement of the law applicable to the phase of the case with which the court was then dealing, and was not calculated to mislead the jury. The evidence showed that on the day of the homicide the deceased, W. B. Shirey, who was sheriff of Troup county, left LaG-range about 12 o’clock noon in an automobile with "Captain Henderson, a revenue man,” S. A. Smith, a deputy sheriff, and Earnest Riley, a chauffeur, for Thompson’s fthe defendant] still, which was 10 or 12 miles from LaGrange. After arriving there, and while breaking up the still,
4. The other grounds of the motion are without merit. The evidence authorized the verdict, and the court did not err in overruling the motion for a new trial.
