Threе members of thе Court wоuld affirm thе judgmеnt of the Appellate Division ‍​​​‌​​‌​‌​​​​‌​‌‌​​​​​‌​‌​‌‌‌‌​‌​‌‌‌​​‌​​​‌​‌​‌‌‍substantially for the reasons expressed in the majority opinion of that Court.

For reversal — Chief Justice Hughes and Justices ‍​​​‌​​‌​‌​​​​‌​‌‌​​​​​‌​‌​‌‌‌‌​‌​‌‌‌​​‌​​​‌​‌​‌‌‍Sullivan, Schreiber and Handler — 4.
