This is an application for a writ of error to the Court of Civil Appeals to reverse a judgment of that court which reversed the judgment of the District Court and remanded the cause. For the purpose of showing that this court has jurisdiction to grant the writ, it is averred in the petition, that "the holding in this case is a different holding on the same question of law to that of the Court of Civil Appeals for the Fourth Supreme Judicial District of the State of Texas, in the case of the International Building and Loan Association v. Fortaissau et ux., 24 Southwestern Reporter, 456."
One of the exceptional cases in which this court may grant a writ of error where a judgment is reversed and the cause remanded, is where "any two of the Courts of Civil Appeals may hold differently on the same question of law." Art. 1011a of the Act of April 13, 1892;
The application is therefore dismissed.
