The appellant has filed a petition for review of the initial decision, which affirmed her removal from Federal service pursuant to 5 U.S.C. chapter 75 and denied her affirmative defenses. Generally, we grant petitions such as this one only in the following circumstances: the initial decision contains erroneous findings of material fact; the initial decision is based on an erroneous interpretation of statute or regulation or the erroneous application of the law to the facts of the case; the administrative judge’s rulings during either the course of the appeal or the initial decision were not consistent with required procedures or involved an abuse of discretion, and the resulting error affected the outcome of the case; or new and material evidence or legal argument is available that, despite the petitioner’s due diligence, was not available when the record closed. Title 5 of the Code of Federal Regulations, section 1201.115 (5 C.F.R. § 1201.115). After fully considering the filings in this appeal, we conclude that the petitioner has not established any basis under section 1201.115 for granting the petition for review. Therefore, we DENY the petition for review and AFFIRM the initial decision, which is now the Board’s final decision. 5 C.F.R. § 1201.113(b).

On petition for review, the appellant asserts, as she did before the administrative judge, that the agency violated her due process rights and committed harmful procedural errors. Petition for Review (PFR) File, Tabs 1, 4. Having considered the appellant’s arguments on review, which largely constitute mere disagreement with the administrative judge’s findings, we discern no reason to reweigh the evidence or substitute our assessment of the record evidence for that of the administrative judge. With respect to the appellant’s argument that the agency failed to afford the appellant an opportunity to comment on certain information during the investigation, PFR File, Tab 1 at 29, we agree with the administrative judge that the Board is foreclosed from reviewing the agency’s denial of eligibility to hold a public trust position, Hall v. Environmental Protection Agency , MSPB Docket No. DC-0752-20-0820-I-2, Appeal File (I-2 AF), Tab 18, Initial Decision at 28. To the extent the appellant may challenge the agency’s purported failure to adhere to its own policies by failing to offer her an opportunity to comment on derogatory information prior to rendering a decision on her eligibility to hold a public trust position, we find that her harmful error

3 claim must fail because she has not shown that an opportunity to respond to the agency’s concerns regarding her education would likely have caused a different result. See 5 C.F.R. § 1201.4(r). It is undisputed that the appellant did not graduate from either university listed on her resume. I-2 AF, Tab 4 at 12. We also address the appellant’s citation to Ramirez v. Department of Homeland Security , 975 F.3d 1342 (2020), for the proposition that the agency was required to provide her with certain documents that were generated during the background investigation prior to her removal. PFR File, Tab 4 at 6-7. Ramirez does not support this assertion and does not require a different result. Ramirez , 975 F.3d at 1353 (“[T]he fact that [the appellant] was unable to [review the documents] during the preliminary pre-removal proceedings is not so substantial and so likely to cause prejudice as to independently justify vacating the removal decision, so long as he is ultimately afforded an opportunity to do so during post-removal arbitration.”) (internal quotations omitted). The appellant has not challenged any other findings by the administrative judge, and we do not address them here. We therefore deny the appellant’s petition for review and affirm the initial decision.

(2) Judicial or EEOC review of cases involving a claim of discrimination . The All Circuit Review Act, signed into law by the President on July 7, 2018, permanently allows appellants to file petitions for judicial review of MSPB decisions in certain whistleblower reprisal cases with the U.S. Court of Appeals for the Federal Circuit or any other circuit court of appeals of competent jurisdiction. The All Circuit Review Act is retroactive to November 26, 2017. Pub. L. No. 115-195, 132 Stat. 1510.
