(After stating the foregoing facts.)
The foregoing disposes of all of the questions made m. the-record which need be considered at length. Some of the grounds of the motion for a new trial do not contain sufficient assignments-, of error to raise any question for decision. Many of them relate-, to questions arising out of the settlement between the parties.. Under the evidence in the record, the judge erred in submitting to the jury any question as to the validity of the settlement, but. should have directed a verdict, against the application for alimony. Not having done this, he should have granted a new'trial on the; ground that the verdict was without evidence to support it. As,
Judgment on the bill of exceptions of J. L. Sumner reversed; writ of error sued out by S. J. Sumner dismissed.
