Justice Day, Justiсe Stеinmеtz, and Justiсе ‍​‌‌‌‌‌​​​​‌​​​‌​​‌​​‌‌​‌‌​‌​​‌​‌‌​​​‌​‌‌​‌‌​​​‌‌‍WILCOX would affirm; Chief Justiсе Heffernan, Justice Abrahamson, and Justice BABLITCH would reverse. Justice Geske withdrew from participation.

Accordingly, the decision of the ‍​‌‌‌‌‌​​​​‌​​​‌​​‌​​‌‌​‌‌​‌​​‌​‌‌​​​‌​‌‌​‌‌​​​‌‌‍court of appeals is affirmed.
