McBride delivered the opinion of the ‍‌​‌​​​‌​​‌‌​‌‌​​​​‌‌‌‌​‌‌‌‌‌​​‌​​​​​​​​​‌‌​‌‌​‌‌‌​​‌‌​​​‌‌‌​​​‌​‌​‌‌‌‌‌​​​​‌‌‌​​‌‌‌‌‌‌‌‌​​‌‌​​‌‌‍court.

More than five months elapsed between the last extension of time for ‍‌​‌​​​‌​​‌‌​‌‌​​​​‌‌‌‌​‌‌‌‌‌​​‌​​​​​​​​​‌‌​‌‌​‌‌‌​​‌‌​​​‌‌‌​​​‌​‌​‌‌‌‌‌​​​​‌‌‌​​‌‌‌‌‌‌‌‌​​‌‌​​‌‌‍filing a transcript on appeal and its actual filing in this Court. ‍‌​‌​​​‌​​‌‌​‌‌​​​​‌‌‌‌​‌‌‌‌‌​​‌​​​​​​​​​‌‌​‌‌​‌‌‌​​‌‌​​​‌‌‌​​​‌​‌​‌‌‌‌‌​​​​‌‌‌​​‌‌‌‌‌‌‌‌​​‌‌​​‌‌‍In compliance with Section 1621, L. O. L., above quoted, the appeal ‍‌​‌​​​‌​​‌‌​‌‌​​​​‌‌‌‌​‌‌‌‌‌​​‌​​​​​​​​​‌‌​‌‌​‌‌‌​​‌‌​​​‌‌‌​​​‌​‌​‌‌‌‌‌​​​​‌‌‌​​‌‌‌‌‌‌‌‌​​‌‌​​‌‌‍will be dismissed, and the cause remanded to the court below, with ‍‌​‌​​​‌​​‌‌​‌‌​​​​‌‌‌‌​‌‌‌‌‌​​‌​​​​​​​​​‌‌​‌‌​‌‌‌​​‌‌​​​‌‌‌​​​‌​‌​‌‌‌‌‌​​​​‌‌‌​​‌‌‌‌‌‌‌‌​​‌‌​​‌‌‍directions to re-sentence the defendant. Dismissed.
