DECISION AND JUDGMENT

* * * * *

Daniel H. Grna, for appellant.

* * * * *

PER CURIAM.

{¶ 1} This matter is before the court on a motion filed by appellant, Larelle A. Mack, for an order to appoint “the firm of Classic Reporting to prepare the transcript in this case at the State‘s expense.” The motion states that the Sylvania Municipal Court found appellant indigent on March 25, 2010.

{¶ 2} In pertinent part, App.R. 9(B) states that the court reporter “is the person appointed by the court to transcribe the proceedings for the trial court * * *[.]” Since appellant does not indicate whether he moved for appointment of a reporter in the trial court, we will presume that he did not. Where a transcript will be required to adjudicate the appeal, and no reporter has been appointed to transcribe the relevant proceedings, a party may file a motion with the trial court asking that a reporter be appointed for that purpose.

{¶ 3} Accordingly, appellant‘s motion for this court to appoint the firm of Classic Reporting to prepare the transcript in this case at the state‘s expense is hereby denied.

{¶ 4} It is so ordered.

MOTION DENIED.
