The defendants were tried before Judge Aldrich and a jury at January, 1903, term of Court of General Sessions for Spartanburg County on the charge of assault and battery with intent to kill upon W. D. Howard, and were convicted of assault and battery of a high and aggravated nature, and sentenced. They appeal upon exceptions to the rulings of the Court as to admissibility of testimony and to the instructions to the jury.
The judgment of the Circuit -Court is reversed, and the case remanded for a new trial.
